Dirty Money Pays for Indiana Gov Mitch Daniels to Tell Anti-American Lies About American Workers

Dirty Money Pays for Indiana Gov Mitch Daniels to Tell Anti-American Lies About American Workers

Indiana Republicans aren't just pushing an anti-union law through the state legislature at warp speed, they're running an ad campaign featuring Gov. Mitch Daniels to try to persuade the public that this is the right move.

The ads are funded by a shadowy group that calls itself the Indiana Opportunity Fund. Public records show the group has spent $600,000 on the “right to work” for less propaganda. But, the group—founded by Republican party activist Jim Bopp—is not required to divulge the source of the cash and Daniels has ignored requests from Hoosier working families, the media and others to disclose whose deep pockets he is dipping into for the advertisements.

It's not just the source of the funding that's a mystery. In the ads, Daniels makes the unsubstantiated claim that "The good is when Indiana gets a chance to compete for new jobs, we're winning two-thirds of the time. But we get cut out of a third of all deals because we don't provide workers the protection known as right to work." Where does that one third figure come from? No one knows, and Daniels isn't telling. One Indiana newspaper editorializes:

Mr. Daniels, you've mentioned that one-third figure several times. And Mr. Bosma, that same logic made right-to-work legislation the Indiana House GOP's top agenda item - one that promises to consume just about every ounce of political capital available at the Statehouse this session.

We ask: What businesses ignored us because Indiana isn't a right-to-work state? And where did those businesses land during this recession? We'd like to get them to tell Hoosiers their side.

Right now, the arguments for right to work are held up as if on clouds. Have faith, Hoosiers; Indiana will be better off as a right-to-work state.

This is the foundational claim of Republican attempts to sell RTW as good for workers, yet they have offered absolutely no evidence to back it up. They've offered tortured, misleading statistics suggesting that RTW states do better economically, but they can't even gin up that level of false evidence about a third of companies not wanting to move to Indiana because of its labor laws. But $600,000 of advertising is a nice big platform for a lie.

We've all heard the same conservative propaganda before. Some how, through magic or wishful thinking, America will be better off if corporations have all the power they want and employees have no rights. American workers should be quiet little wage slaves and be thankful to their corporate masters for being nice enough to let them work. Where do corporate profits come from? The work done by American workers who make the products and provide the services that make the corporate elite wealthy. Conservatism tries to convince everyone that only the corporate lite creates capital - one of the biggest lies ever told about how economics works..

Remember when Mitt Romney attacked 'free enterprise'? Why do conservative have so much contempt for America that they tell the most obvious lies and create such a bizarre version of reality. They truly believe America is a nation of idiots.

The Year 2011 Was The Year That Anti-American Conservative Talking Points About Obama's Foreign Policy Crumbled

The Year 2011 Was The Year That Anti-American Conservative Talking Points About Obama's Foreign Policy Crumbled

Since President Obama took office, right-wing (conservative) media have argued that his foreign policy is making the United States less safe and is bent on attacking Israel. Those attacks have continued in 2011, even as the Obama administration has overseen the death of Al Qaeda leaders Osama bin Laden and Anwar Al-Awlaki, repeatedly supported Israel, and been praised by Israeli leaders.

RIGHT-WING MEDIA CLAIM: Obama Is Anti-Israel And His Administration Is Anti-Semitic

RIGHT-WING MEDIA CLAIM: Obama's Speech On Israeli-Palestinian Peace Based On '67 Borders With Agreed Swaps Condoned "Potential Genocide"

RIGHT-WING MEDIA CLAIM: Obama Is Supporting "Intifada" Against Israel By Restating U.S. Policy Regarding Settlements
RIGHT-WING MEDIA CLAIM: Obama Is Making The U.S. Less Safe

Since Obama Took Office, Right-Wing Media Have Repeatedly Suggested That He Is Weak On Terror And Not Serious About Defending America From Terrorism Threats.

REALITY: Obama Administration Oversaw The Killing Of Osama Bin Laden And Other Terrorist Leaders

    [The New York Times, 5/2/11]

Obama Authorized The Operation That Resulted In The Death Of Osama Bin Laden. Following the killing of Osama bin Laden, The Washington Post reported that the "surgical" special forces operation that resulted in the terrorist leader's death was authorized by President Obama on Friday, April 29 after months of intelligence gathering, and was carried out early the following Monday morning (local time) as a small force of elite American troops descended on bin Laden's compound in Abbottabad, Pakistan. According to the Post, the U.S. "did not share any intelligence with foreign governments, including Pakistan's."

Obama Ordered Drone Strike That Killed Anwar Al-Awlaki, An American-Born Al Qaeda Leader. Reuters reported on September 30:

The killing of Anwar al-Awlaki in Yemen on Friday by a U.S. drone strike is the culmination of two years of extensive U.S. efforts to track down the American-born member of al Qaeda and put him out of action.

Under Obama, FBI And DEA Agents Foiled Alleged Iranian Plot To Assassinate Saudi Ambassador To The U.S. ABC News reported on October 11:

FBI and DEA agents have disrupted a plot to commit a "significant terrorist act in the United States" tied to Iran, federal officials told ABC News today.

Numerous Other Terrorist Leaders Have Been Killed During Obama's Presidency. In a September 30 blog post, ABC's Jake Tapper compiled a list of senior terrorist leaders killed during Obama's presidency. From Tapper's post:

Earlier this month officials confirmed that al Qaeda's chief of Pakistan operations, Abu Hafs al-Shahri, was killed in Waziristan, Pakistan.

In August, 'Atiyah 'Abd al-Rahman,  the deputy leader of al Qaeda was killed.

In June, one of the group's most dangerous commanders, Ilyas Kashmiri,  was killed in Pakistan. In Yemen that same month, AQAP senior operatives Ammar al-Wa'ili, Abu Ali al-Harithi, and Ali Saleh Farhan were killed. In Somalia, Al-Qa'ida in East Africa (AQEA) senior leader Harun Fazul was killed.

Administration officials also herald the recent U.S./Pakistani joint arrest of Younis al-Mauritani  in Quetta.

Going back to August 2009, Tehrik e-Taliban Pakistan leader Baitullah Mahsud was killed in Pakistan.

In September of that month, Jemayah Islamiya operational planner Noordin Muhammad Top was killed in Indonesia, and AQEA planner Saleh Ali Saleh Nabhan was killed in Somalia.

Then in December 2009 in Pakistan, al Qaeda operational commanders Saleh al-Somali and 'Abdallah Sa'id were killed.

In February 2010, in Pakistan,  Taliban deputy and military commander Abdul Ghani Beradar was captured; Haqqani network commander Muhammad Haqqani was killed; and Lashkar-e Jhangvi leader Qari Zafar was killed.

In March 2010, al Qaeda operative Hussein al-Yemeni was killed in Pakistan, while senior Jemayah Islamiya operative Dulmatin -- accused of being the mastermind behind the 2002 Bali bombings -- was killed during a raid in Indonesia.

In April 2010, al Qaeda in Iraq leaders Abu Ayyub al-Masri and Abu Omar al-Baghdadi were killed.

In May, al Qaeda's number three commander, Sheik Saeed al-Masri was killed.

In June 2010 in Pakistan, al Qaeda commander Hamza al-Jawfi was killed. [Political Punch, 9/30/11, via ABCNews.com]

RIGHT-WING MEDIA CLAIM: Obama's Actions In Libya Were Incoherent And Dangerous For Israel

REALITY: With U.S., NATO Support, Libyans Overthrew Gadhafi

Wash. Post: Libyan Rebels Captured, Killed Gadhafi Following "Unprecedented NATO Air Campaign." The Washington Post reported on October 20:

Former Libyan dictator Moammar Gaddafi was killed Thursday after being seized in a sewage tunnel in his home town -- the final triumph for pro-democracy fighters who have struggled for eight months to take control of the country.

Gaddafi's death came on a day of intense military activity in Sirte, the last loyalist holdout in Libya, where his supporters had fended off better-armed revolutionaries for weeks. Before his capture, a U.S. drone and French fighter jets fired on a large, disorganized convoy leaving the city that he appears to have been in. It was not clear whether the airstrikes hit Gaddafi's vehicles, NATO officials said.

RIGHT-WING CONSERVATIVE MEDIA CLAIM: Obama Is Anti-Israel And His Administration Is Anti-Semitic

REALITY: Obama Has Stood By Israel And Lobbied Against Palestinian Statehood At The UN

    [WhiteHouse.gov, 9/21/11]

Obama Declared His Opposition To Palestinian Statehood Bid At The UN

Obama: "Peace Will Not Come Through Statements And Resolutions At The U.N." The New York Times reported on September 21:

President Obama declared his opposition to the Palestinian Authority's bid for statehood through the Security Council on Wednesday, throwing the weight of the United States directly in the path of the Arab democracy movement even as he hailed what he called the democratic aspirations that have taken hold throughout the Middle East and North Africa.
Israeli Prime Minister Netanyahu Has Repeatedly Praised Obama

Netanyahu On Obama's Opposition To A Unilaterally-Declared Palestinian State: "I Think This Is A Badge Of Honor And I Want To Thank You For Wearing That Badge Of Honor." From a statement by Israeli Prime Minister Benjamin Netanyahu:

Netanyahu  "Offered A Special Thank You" To Obama For Helping To Free Israelis Detained In Cairo. From a Jerusalem Post article:

Israel will continue to adhere to the peace treaty with Egypt, which serves the interest of both countries, Prime Minister Binyamin Netanyahu said on Saturday night, at the end of a dramatic 24-hours during which an Egyptian mob laid siege to Israel's embassy in Cairo.

All of Israel's emissaries to Cairo -- including six security guards who were holed up behind a metal door in the embassy and extracted by Egyptian commandos -- returned to Israel on Saturday, with the exception of one diplomat who will remain to represent Israel in the Egyptian capital.

Netanyahu, in a televised announcement on Saturday night, offered a special thank you to US President Barack Obama who "said he would do everything he could" to extricate the six security guards, "and did.
Netanyahu "Expressed His Deep Appreciation" For U.S. Funding For Missile Defense System For Israel. From an April 18 Agence France-Presse article:

Former Israeli Prime Minister And Current Defense Minister Ehud Barak: "I Can Hardly Remember A Better Period Of ... American Support" For Israel Than "Right Now." From the August 3 edition of Fox News' On the Record with Greta Van Susteren:

A Majority Of Jewish Israelis Have A Favorable View Of Obama

Brookings: "A Majority (54%) Of Israeli Jews Polled In 2011 Expressed A Favorable View Of [Obama]." A "2011 Public Opinion Poll of Jewish and Arab Citizens of Israel" by the Brookings Institution's Saban Center for Middle East Policy found that a "majority" of Israeli Jews support Obama:
Just another year in which the deeply anti-American movement known as conservatism has the nerve to wrap its lies and Anti-American agenda in the flag and the Bible to deceive and mislead the American people. It is time for real Americans to stand up and push back at this dangerous anti-democracy political radicals known as conservative Republicans.

Ron Paul(R-TX) May Be a Useful Tool, But He is a Crackpot

Ron Paul(R-TX) May Be a Useful Tool, But He is a Crackpot

Can we talk? Ron Paul is not a charming oddball with a few peculiar notions. He's not merely "out of the mainstream." Ron Paul is a full bore crank. In fact he's practically the dictionary definition of a crank: a person who has a single obsessive, all-encompassing idea for how the world should work and is utterly blinded to the value of any competing ideas or competing interests.

This obsessive idea has, at various times in his career, led him to: denounce the Civil Rights Act because it infringed the free-market right of a monolithic white establishment to immiserate blacks; dabble in gold buggery and advocate the elimination of the Federal Reserve, apparently because the global economy worked so well back in the era before central banks; suggest that the border fence is being built to keep Americans from leaving the country; claim that Social Security and Medicare are unconstitutional and should be dismantled; mount repeated warnings that hyperinflation is right around the corner; insist that global warming is a gigantic hoax; hint that maybe the CIA helped to coordinate the 9/11 attacks; oppose government-sponsored flu shots; and allege that the UN wants to confiscate our guns.

This isn't the biography of a person with one or two unusual hobbyhorses. It's not something you can pretend doesn't matter. This is Grade A crankery, and all by itself it's reason enough to want nothing to do with Ron Paul. But of course, that's not all. As we've all known for the past four years, you can layer on top of this Paul's now infamous newsletters, in which he condoned a political strategy consciously designed to appeal to the worst strains of American homophobia, racial paranoia, militia hucksterism, and new-world-order fear-mongering. And on top of that, you can layer on the fact that Paul is plainly lying about these newsletters and his role in them.

Now, balanced against that you have the fact that Paul opposes the War on Drugs and supports a non-interventionist foreign policy. But guess what? Even there, he's a crank. Even if you're a hard-core non-interventionist yourself, you probably think World War II was a war worth fighting. But not Ron Paul. He thinks we should have just minded our own damn business. And even if you're a hardcore opponent of our current drug policy — if you think not just that marijuana should be legalized, not just that hard drugs should be decriminalized, but that all illicit drugs should be fully legalized — I'll bet you still think that maybe we should retain some regulations on a few of the worst drugs. They're pretty dangerous, after all, and no matter how much you hate the War on Drugs you might have a few qualms about a global marketing behemoth like RJ Reynolds having free rein to advertise and sell anything it wants, anywhere it wants, in any way it wants. But not Ron Paul. As near as I can tell, he just wants everything legalized, full stop.

Bottom line: Ron Paul is not merely a "flawed messenger" for these views. He's an absolutely toxic, far-right, crackpot messenger for these views. This is, granted, not Mussolini-made-the-trains-run-on-time levels of toxic, but still: if you truly support civil liberties at home and non-interventionism abroad, you should run, not walk, as fast as you can to keep your distance from Ron Paul. He's not the first or only person opposed to pre-emptive wars, after all, and his occasional denouncements of interventionism are hardly making this a hot topic of conversation among the masses. In fact, to the extent that his foreign policy views aren't simply being ignored, I'd guess that the only thing he's accomplishing is to make non-interventionism even more of a fringe view in American politics than it already is. Crackpots don't make good messengers.
Paul just seems revolutionary to some young liberals because they don't remember when the far Right was full of isolationists conservatives. To be a modern conservatives means to put the U.S. military into whatever situation they feel like on any particular day. Other than his isolationism which is taken as being a promoter of peace, Paul is just an anti-American extremist like most modern conservatives.

Wisconsin Right-wing Nut Governor Scott Walker Thinks Corporate Taxes Can Never be Low Enough and he is Willing to Kill Women to Prove It

Wisconsin Right-wing Nut Governor  Scott Walker Thinks Corporate Taxes Can Never be Low Enough and he is Willing to Kill Women to Prove It

First he gutted worker's rights [1], then slashed state education funding [2] and dumbed-down sex ed [3]. Next on Wisconsin Gov. Scott Walker's hit list? Breast and cervical cancer screenings for women. Come January 1, Wisconsinites who rely on Planned Parenthood to access free cancer screenings may be out of luck.

The Wisconsin Well Woman Program [4] is an 17-year-old state service created to ensure that women ages 45 to 64 who lack health insurance can access preventive health screenings. It is administered by the Department of Health Services and provides referrals and screenings for breast cancer, cervical cancer, and multiple sclerosis at no cost. The state currently uses a number of contractors to coordinate and provide those services, including Planned Parenthood. But now, in a move that could leave many women in the state without access to the program, the Walker government is ending Planned Parenthood's contract.

In four Wisconsin counties, Planned Parenthood is the only health care provider currently contracted as a coordinator for the cancer screenings. Coordinators evaluate women for eligibility, enroll them in the program, and then connect them to health care providers that can perform the exams. The coordinators also do community outreach, letting women know that there are options for preventative care even if they don't have health insurance. Planned Parenthood Advocates of Wisconsin has been a contractor since the program began—including during the terms of previous GOP governors Tommy Thompson and Scott McCallum—but the group recently learned that its contract is being terminated at the end of the month.

Beth Kaplan, a spokeswoman for the Department of Health Services, told Mother Jones that no decision has been made on the contract and would not comment on why it might not be continued. But Tanya Atkinson, executive director of Planned Parenthood Advocates of Wisconsin, says they were told that the state is cutting them out of the program. "They have very clearly stated that they were ending the contract with us," she says. [UPDATE: Walker himself has confirmed [5] that the state is ending its contract with Planned Parenthood.]

Atkinson says the DHS cut is politically motivated; as far as she knows, her group was the only service provider whose contract was not renewed. The move puts in question what will happen to the more than 1,000 women that access the Well Woman Program through Planned Parenthood in Winnebago, Fond du Lac, Sheboygan, and Outagamie counties every year. Doctors found 15 cases of cervical and breast cancer in the 1,260 women screened in those counties in 2010—cases that likely would not have been detected if women didn't have access to the Well Woman Program. The county health officers in two of those counties have already issued statements decrying the state for targeting Planned Parenthood for the cut and for risking the health of their residents.

"If it's not Planned Parenthood, then who's going to coordinate? Where do women go?" Atkinson asks. "We don't have any indication at this point."

If Walker goes through with the cut, women like Laurie Seim might not get the services they need. Two years ago, the 52-year-old Seim discovered a lump in her breast and started feeling feverish and sick. Even though she had a part-time job as a medical assistant, she didn't have health insurance and had never had a mammogram. The doctor she worked for sent her to the Well Woman Program coordinator at the Outagamie office of Planned Parenthood. She was able to get a mammogram the next day as well as an ultrasound, and both were covered by the program. Thankfully, she learned she had a cyst, not cancer. But without the program, she says, she probably wouldn't have gotten that care.

"I didn't have to worry about anything. It was such a godsend," Seim says. "If I hadn't been referred to that program, I don't know what I would have done." She worked in the medical field but still didn't know how to navigate the system. "Well Woman was there for me."

Just another day among the fake patriots who call themselves conservatives. They honestly believe in having a dog-eat-dog survival of the lucky society. If you have health problems and cannot afford care, conservative Republicans believe you should die. They proved that to the entire nation when they applauded a question during the Republican debates about letting someone without health insurance die.

Yet Another Anti-American Republican Ignores Constitution - Gingrich Front Group Calls For Punishing Judges By Eliminating Their Court

Yet Another Anti-American Republican Ignores Constitution - Gingrich Front Group Calls For Punishing Judges By Eliminating Their Court

Earlier this month, a unanimous panel of 9th Circuit judges held that a 43-foot tall Latin cross cannot constitutionally be displayed on federal land in San Diego. Even though this decision flows naturally from the First Amendment and from Supreme Court decisions forbidding the government from endorsing Christianity — or any other faith — above others, the right’s reaction to this decision has been predictably apoplectic.

Perhaps the most unhinged reaction comes from Newt Gingrich’s Renewing American Leadership, which proclaims that the judges who decided this case must be punished by having their court abolished:

Upon ascending to the presidency, Jefferson then did something remarkable — he and his congressional allies passed the Judicial Act of 1803 that simply abolished the newly-created judgeships and the courts they presided over. He reminded the deposed judges that they had no cases to hear, no building in which to hear them, and no funding for their salaries. The former judges took their case to the Supreme Court, demanding that their positions be restored. Under the plain terms of the Constitution, however, they didn’t have a leg to stand on, and President Jefferson emerged victorious.

Today we face a similar issue: those whose policies are unable to win at the ballot box are seeking to build a stronghold of government power in the courts, without needing to garner a single vote. Just as it did in 1803, the Executive and Legislative branches could take action today and ”reorganize” the Ninth Circuit Court right out of existence!

Gingrich himself made a similar argument last year, when he told the now-floundering CPAC convention that Thomas Jefferson’s “judicial reform act of 1802 abolished 18 out of 35 federal judges, over half…I am more cautious than Jefferson. I would only abolish the Ninth Circuit Court.” This proposal, however, has one big flaw: the United States Constitution.

The Constitution provides that “[t]he judges, both of the supreme and inferior courts, shall hold their offices during good behaviour, and shall, at stated times, receive for their services, a compensation, which shall not be diminished during their continuance in office,” a provision which exists entirely to prevent Congress from strong-arming judges by threatening their jobs. While there is some precedent for reducing the size of a judge’s area of jurisdiction for non-punitive reasons — the 5th Circuit was split into two circuits in 1981 after it became too large and unwieldy — an Act of Congress which effectively stripped a court’s judges of all their responsibilities would certainly run afoul of the Constitution.

Moreover, while Gingrich is correct that Jefferson did unconstitutionally abolish several federal judgeships, this precedent is best read as a sign that the framers, while brilliant, were no less capable of letting their passions overcome their ability to follow the Constitution than modern lawmakers occasionally prove to be. Indeed, Jefferson himself came to power in part because of a nationwide backlash against wildly unconstitutional laws passed by his predecessor.

Ultimately, however, the most frightening thing about Gingrich’s proposal isn’t its direct conflict with the Constitution, but the implications of such a violation of the Constitution for a fair and impartial judiciary. The framers protected judges from exactly this kind of intimidation because they knew that judges cannot be trusted to enforce unpopular laws or to extend the law’s protection over unpopular groups if they constantly have to watch their backs. At the end of the day, Gingrich’s proposal is nothing more than another sign of the right’s utter contempt for the Constitution and the law.

Gingrich is supposed to be one of the big thinkers of the Anti-American conservative movement. Which just goes to prove how low their standards are to be considered a great thinker.

Newest Hacked Climate E-Mails Still Fail to Disprove Global Warming

Newest Hacked Climate E-Mails Still Fail to Disprove Global Warming

The UK Guardian reports today that the deniers are serving 2-year-old leftovers for Thanksgiving:

Fresh round of hacked climate science emails leaked online

A file containing 5,000 emails has been made available in an apparent attempt to repeat the impact of 2009's similar release….

The initial email dump was apparently timed to disrupt the Copenhagen climate talks. It prompted three official inquiries in the UK and two in the US into the working practices of climate scientists. Although these were critical of the scientists’ handling of Freedom of Information Act requests and lack of openness they did not find fault with the climate change science they had produced.

Norfolk police have said the new set of emails is “of interest” to their investigation to find the perpetrator of the initial email release who has not yet been identified.

Actually nine independent investigations have vindicated climate science and climate scientists on the hacked University of East Anglia emails (as Skeptical Science explains, for those who want the full history).

As one scientist put it to me today:

“Two years ago, emails were released and the American people were lied to about their content.  Now, we are expected to be gullible enough to believe the original liars a second time.”

Media Matters also has a good post, “Memo To Media: Research First, Then Report On Climate Emails.”

The bad news is that, as Media Matters explains in its latest post, “Media Already Botching Reports On Hacked Climate Emails,” with some awful “reporting” by the Washington Post already (see below).

The good news is that the perpetrators and their fellow deniers apparently think the international climate talks in Durban are actually important enough to try to trick the media once again into prematurely running stories on out-of-context excerpts from private emails from scientists, most of which were written years ago, discussing science that has long since been resolved.

Leftovers, again? One climate scientist calls the email dump, “Two-year-old turkey from Thanksgiving 2009.”

These are the “second string” emails.  The Varsity team couldn’t derail the science so it’s  really hard to see how the Junior Varsity team could. In other words, if multiple independent investigations showed that climate science was unscathed by the original batch of emails — which must have been the ones the deniers thought were the best they had — then what precisely are the chances these even weaker second-stringers are going to beat the climate science team?  After all, the climate science team has gotten considerably stronger in recent years.

The U.S. National Academy of Sciences concluded its 2010 review of climate science, saying it is a “settled fact” that “the Earth system is warming.”  As for the cause, last year, Time reported on a comprehensive new review paper of “100 peer-reviewed post-IPCC studies” in an article titled, “Report: The Case for Global Warming Stronger Than Ever”:

By looking at a wide range of observations from all over the world,  the Met Office study concludes that the fingerprint of human influence on climate is stronger than ever. “We can say with a very high significance level that the effects we see in the climate cannot be attributed to any other forcings [factors that push the climate in one direction or another],” says study co-author Gabriele Hegerl of the University of Edinburgh.
ironically or maybe just a joke on everyone gullible enough to stumble across their crazy rants a site called Junk Science is using the newest old e-mails as proof there ain't no such thing as global warming. They have no science to back them up. Perhaps they're called Junk Science because that is what they believe in, junk.

Is Mitt Romney Morally Fit to Be President - He refused to help decorated Iraq war veteran become a cop

Is Mitt Romney Morally Fit to Be President - He refused to help decorated Iraq war veteran become a cop

In an article documenting Mitt Romney's decade-long campaign for the presidency comes this extraordinary profile in political and moral cowardice:

As Steve LeBlanc of The Associated Press documented in 2007, Romney issued no pardons or commutations while serving as governor, despite some seemingly benign pleas.

In one of them, Anthony Circosta, a decorated Iraq war veteran, requested a pardon so he could pursue a career as a police officer.

His background was marred because, as a 13 year old, he was convicted of assault for shooting another boy in the arm with a BB gun.

The shot that did not break the other child’s skin.

Nonetheless, Circosta’s plea was among the 100 requests for commutations and 172 requests for pardons that all were denied during Romney’s four years in office.

Apparently, Mitt Romney didn't want to risk having a Mike Dukakis-style Willie Horton issue appear on the campaign trail. Of course, even though Circosta "worked his way through college, joined the Army National Guard, and led a platoon of 20 soldiers in Iraq’s deadly Sunni triangle," Romney refused to help.

When it came to addressing George W. Bush's commutation of Scooter Libby's sentence, Romney defended it, however. So why the sudden shift from Romney? Simple: He was running for office, for Pete's sake. Republican office.

In case you do not remember Scooter Libby lied to protect V.P. Cheney from being prosecuting for exposing the identity f a CIA NOC agent who specilized in Middle-East WMD intelligence. Romney has the same priotites as every wing-nut conservative - party first, America and decency last.

America's Internet Might Become As Bad As China - Stop SOPA

America's Internet Might Become As Bad As China

China operates the world’s most elaborate and opaque system of Internet censorship. But Congress, under pressure to take action against the theft of intellectual property, is considering misguided legislation that would strengthen China’s Great Firewall and even bring major features of it to America.

The legislation — the Protect IP Act, which has been introduced in the Senate, and a House version known as the Stop Online Piracy Act — have an impressive array of well-financed backers, including the United States Chamber of Commerce, the Motion Picture Association of America, the American Federation of Musicians, the Directors Guild of America, the International Brotherhood of Teamsters and the Screen Actors Guild. The bills aim not to censor political or religious speech as China does, but to protect American intellectual property. Alarm at the infringement of creative works through the Internet is justifiable. The solutions offered by the legislation, however, threaten to inflict collateral damage on democratic discourse and dissent both at home and around the world.

The bills would empower the attorney general to create a blacklist of sites to be blocked by Internet service providers, search engines, payment providers and advertising networks, all without a court hearing or a trial. The House version goes further, allowing private companies to sue service providers for even briefly and unknowingly hosting content that infringes on copyright — a sharp change from current law, which protects the service providers from civil liability if they remove the problematic content immediately upon notification. The intention is not the same as China’s Great Firewall, a nationwide system of Web censorship, but the practical effect could be similar.

Abuses under existing American law serve as troubling predictors for the kinds of abuse by private actors that the House bill would make possible. Take, for example, the cease-and-desist letters that Diebold, a maker of voting machines, sent in 2003, demanding that Internet service providers shut down Web sites that had published internal company e-mails about problems with the company’s voting machines. The letter cited copyright violations, and most of the service providers took down the content without question, despite the strong case to be made that the material was speech protected under the First Amendment.

The House bill would also emulate China’s system of corporate “self-discipline,” making companies liable for users’ actions. The burden would be on the Web site operator to prove that the site was not being used for copyright infringement. The effect on user-generated sites like YouTube would be chilling.

YouTube, Twitter and Facebook have played an important role in political movements from Tahrir Square to Zuccotti Park. At present, social networking services are protected by a “safe harbor” provision of the Digital Millennium Copyright Act, which grants Web sites immunity from prosecution as long as they act in good faith to take down infringing content as soon as rights-holders point it out to them. The House bill would destroy that immunity, putting the onus on YouTube to vet videos in advance or risk legal action. It would put Twitter in a similar position to that of its Chinese cousin, Weibo, which reportedly employs around 1,000 people to monitor and censor user content and keep the company in good standing with authorities.

Compliance with the Stop Online Piracy Act would require huge overhead spending by Internet companies for staff and technologies dedicated to monitoring users and censoring any infringing material from being posted or transmitted. This in turn would create daunting financial burdens and legal risks for start-up companies, making it much harder for brilliant young entrepreneurs with limited resources to create small and innovative Internet companies that empower citizens and change the world.

Adding to the threat to free speech, recent academic research on global Internet censorship has found that in countries where heavy legal liability is imposed on companies, employees tasked with day-to-day censorship jobs have a strong incentive to play it safe and over-censor — even in the case of content whose legality might stand a good chance of holding up in a court of law. Why invite legal hassle when you can just hit “delete”?

The potential for abuse of power through digital networks — upon which we as citizens now depend for nearly everything, including our politics — is one of the most insidious threats to democracy in the Internet age. We live in a time of tremendous political polarization. Public trust in both government and corporations is low, and deservedly so. This is no time for politicians and industry lobbyists in Washington to be devising new Internet censorship mechanisms, adding new opportunities for abuse of corporate and government power over online speech. While American intellectual property deserves protection, that protection must be won and defended in a manner that does not stifle innovation, erode due process under the law, and weaken the protection of political and civil rights on the Internet.

What caused the financial crisis? The Big Lie goes viral.

Some stand to profit from the status quo: Banks present a systemic risk to the economy, and reducing that risk by lowering their leverage and increasing capital requirements also lowers profitability. Others are hired guns, doing the bidding of bosses on Wall Street.

They all suffer cognitive dissonance — the intellectual crisis that occurs when a failed belief system or philosophy is confronted with proof of its implausibility.

And what about those facts? To be clear, no single issue was the cause. Our economy is a complex and intricate system. What caused the crisis? Look:

Fed Chair Alan Greenspan dropped rates to 1 percent — levels not seen for half a century — and kept them there for an unprecedentedly long period. This caused a spiral in anything priced in dollars (i.e., oil, gold) or credit (i.e., housing) or liquidity driven (i.e., stocks).

Low rates meant asset managers could no longer get decent yields from municipal bonds or Treasurys. Instead, they turned to high-yield mortgage-backed securities. Nearly all of them failed to do adequate due diligence before buying them, did not understand these instruments or the risk involved. They violated one of the most important rules of investing: Know what you own.

Fund managers made this error because they relied on the credit ratings agencies — Moody’s, S&P and Fitch. They had placed an AAA rating on these junk securities, claiming they were as safe as U.S. Treasurys.

• Derivatives had become a uniquely unregulated financial instrument. They are exempt from all oversight, counter-party disclosure, exchange listing requirements, state insurance supervision and, most important, reserve requirements. This allowed AIG to write $3 trillion in derivatives while reserving precisely zero dollars against future claims.

• The Securities and Exchange Commission changed the leverage rules for just five Wall Street banks in 2004. The “Bear Stearns exemption” replaced the 1977 net capitalization rule’s 12-to-1 leverage limit. In its place, it allowed unlimited leverage for Goldman Sachs, Morgan Stanley, Merrill Lynch, Lehman Brothers and Bear Stearns. These banks ramped leverage to 20-, 30-, even 40-to-1. Extreme leverage leaves very little room for error.

•Wall Street’s compensation system was skewed toward short-term performance. It gives traders lots of upside and none of the downside. This creates incentives to take excessive risks.

• The demand for higher-yielding paper led Wall Street to begin bundling mortgages. The highest yielding were subprime mortgages. This market was dominated by non-bank originators exempt from most regulations. The Fed could have supervised them, but Greenspan did not.

• These mortgage originators’ lend-to-sell-to-securitizers model had them holding mortgages for a very short period. This allowed them to get creative with underwriting standards, abdicating traditional lending metrics such as income, credit rating, debt-service history and loan-to-value.

• “Innovative” mortgage products were developed to reach more subprime borrowers. These include 2/28 adjustable-rate mortgages, interest-only loans, piggy-bank mortgages (simultaneous underlying mortgage and home-equity lines) and the notorious negative amortization loans (borrower’s indebtedness goes up each month). These mortgages defaulted in vastly disproportionate numbers to traditional 30-year fixed mortgages.

To keep up with these newfangled originators, traditional banks developed automated underwriting systems. The software was gamed by employees paid on loan volume, not quality.

The people blaming government, Fannie May and whatever boogieman are just plain old gutless liars.

America Hater Newt Gingrich Has Ethics. They Just Happen to Be Abominable

America Hater Newt Gingrich Has Ethics. They Just Happen to Be Abominable

The GOP presidential primary is a lot like a kindergarten t-ball game: When it comes to being in first place, just about everybody gets a turn. And now, congratulations, Newt Gingrich: It’s your turn!

Steve Kornacki wrote about the Public Policy Polling survey that found Gingrich is following in the footsteps of Donald Trump, Michele Bachmann, Rick Perry and Herman Cain as the Republican flavor of the week. Gingrich benefits from three things: A lot of Republicans can’t stand Mitt Romney, Cain and Perry have shamed themselves in public, and by contrast, he’s had no bad debates. So far he’s come off as smart and affable, trying to rally his rivals against the big, bad media that’s trying to get them to fight.

Since Gingrich has mostly been in single digits, far back in the polls, his rivals have humored him and ignored his liabilities. That’s about to change, and Gingrich, like Perry, Cain and Michele Bachmann before him, will likewise wither under the hot sun of political scrutiny. The seemingly affable professor and author is a hothead with many political liabilities and almost as many enemies. He’s committed so many political and ethical transgressions that his baggage has baggage.

Gingrich is probably best known for serving his wife with divorce papers while she was recovering from cancer surgery, so he could marry his mistress, whom he later divorced to marry a staffer. But he’s also probably the only politician, who when you’re asked “What’s the worst thing he’s done?” has done a lot of things that rival leaving his cancer-stricken wife for his mistress. For most people in the world, in fact, that would be the hands-down worst act ever; for Gingrich, it’s just not that clear-cut (h/t Jamie Kilstein).

For instance, he’s the only House speaker in American history to be disciplined by Congress for ethics violations.  In 1998, he paid a $300,000 fine after he was found to have been misusing his tax-exempt foundations for political gain.

OK, those have to be the two worst things, dumping his wife who had cancer for his mistress, and congressional ethics sanctions, right?

But wait, but there’s more:

Shutting down the government in 1995 at least partly because President Clinton allegedly snubbed him by seating him in the rear of Air Force One on a flight home from Yitzhak Rabin’s funeral. No, really, he told reporters the “snub” was “part of why you ended up with us sending down a tougher continuing resolution.”
Advocating that the children of welfare recipients be taken away from their parents and raised in orphanages.
Leading the drive to impeach Clinton over lying about adultery when he was himself lying about adultery, cheating on his wife with a staffer, Callista Bisek, who became his third wife.
Insisting President Obama suffers from “a Kenyan anti-colonial mindset” like his Kenyan father, even though he barely knew his Kenyan father.
Denouncing Paul Ryan’s radical budget (that was actually smart) as “right-wing social engineering,” then flip-flopping and warning that “any ad which quotes what I said Sunday is a falsehood.”
Railing against Obama’s alleged “class warfare” when he’s run up a $500,000 tab at Tiffany’s.
But my all-time favorite Newt Gingrich “worst” was the time he blamed the horrendous case of Susan Smith, the South Carolina mother( a Republican who was having an affair with her Republican father-in-law) who murdered her young sons in 1994, on Democrats. Smith, you’ll recall, first blamed her son’s drowning deaths on a black man who supposedly car-jacked her, but it turned out, she did it herself. Just before the 1994 election, in which his party swept back into power, Gingrich said:

I think that the mother killing the two children in South Carolina vividly reminds every American how sick the society is getting and how much we need to change things. The only way you get change is to vote Republican. That’s the message for the last three days.

Two days later, Gingrich defended his comments by insisting he’d been saying the same thing for years: that Democratic rule had frayed the moral fabric of the country: “We need very deep change if we’re going to turn this country around.” Asked directly if he was saying electing Republicans could stop killings like Smith’s, he said flatly: “Yes. In my judgment, there’s no question.”

He later blamed the Columbine and Virginia Tech killings on liberals, too.

America has never been perfect, but its "moral" fabric has always been in most danger by conservatism. Conservatism - forget the names of the political parties Republicans and Democrats, liberals and conservatives were in both parties until the 1980s - has always been the biggest threat to America. Conservatism by its very nature is anti-American. Conservatism as a movement has more in common with the ultra-nationalism of the Japanese leading up to WW II. Gingrich fits in perfectly. he believes in a dog-eat-dog culture and economy. He believes America should be ruled by the elite and voting rights given only to those who believe in the far Right agenda.

Scott Walker recall, Day 1, by the numbers and you can download a Walker recall form here. Beware of false recalls conservative nuts who will throw your recall petition in the trash.

Conservatism Has Become The Cult of Ayn Rand

Conservatism Has Become The Cult of Ayn Rand

Many have commented on the remarkable callousness fashioned by this Republican presidential field. Most prominently, Herman Cain maintained that the poor and unemployed are responsible for their own plight; Ron Paul claimed that people who refrain from buying health insurance but become debilitated should not be bailed out by government healthcare—they should just die instead, his audience helpfully suggested (or hollered, rather); and just about all the candidates have recommended ever harsher, ever more absurd measures to keep out poor immigrants on our border with Mexico: double fences, electric fences, even soldiers with ‘real guns and real bullets,’ as Herman Cain put it.

What’s driving this show of meanness? You might say it’s just what the electorate—or some loud part thereof—wants. It seems like there are some seriously angry voters out there these days, and I’m sure the recession is taking a toll on people’s patience and generosity. And yet, I suspect this is no fleeting trend, but something with deeper ideological roots. In short, I sense Ayn Rand.

Rand has always had a good following, but her popularity has surged in recent years as conservatives repeatedly invoked her to counter Obama’s “Socialist” agenda. She has an impressive roster of conservative devotees: Clarence Thomas, Rush Limbaugh, Glenn Beck, and Ron Paul. Paul’s son, Senator Rand Paul quoted Ayn Rand at length during a congressional committee meeting this past year—to argue against government mandates for energy efficient light bulbs, of all things. Congressman Paul Ryan, the rising star from Wisconsin who drafted the Republican’s celebrated plan to slash the federal budget, reportedly urges all his staffers to read her works.

This is a powerful fan-base, and many have feared the consequences of Rand’s influence. I think we are seeing it now, for there are clear strains of her venom in the excesses of the Republican candidates—and beyond. Her trademark callousness is increasingly evident throughout our political discourse regarding the poor and vulnerable of society. The congressional super-committee charged with agreeing on a trillion dollars in federal deficit reduction is reportedly contemplating cuts to food stamps, while Republicans remain steadfast that taxes not rise on the rich. This, as the recession lingers and poverty rates soar, and we witness the greatest concentration of wealth among the rich since the 1920s. The Republican stance is mind-boggling in these circumstances—but Rand would certainly approve; indeed, she might favor far worse. Consider:

In her popular novels, Rand glorifies ambitious, fiercely independent individuals who soar and succeed by virtue of their own resources and willpower alone. It’s her ode to individualism that captivates her fans. Also the simplicity of her world view, I suspect: Rand’s is a Manichean universe populated by a few great souls on one side, and the inept masses on the other; the masses would perennially muddle in their own misery if not for the exceptional creativity and bravery of a few to do great things, and it’s up to the masses to keep out of their way. In Atlas Shrugged, Rand declares “The man at the top of the intellectual pyramid contributes the most to all those below him, but gets nothing except his material payment, receiving no intellectual bonus from others to add to the value of his time.” Upon little reflection, Rand’s reasoning is obviously specious. Who on earth rises to the top without the help of someone, anyone at all? Indeed, luck plays an important role in a person’s success, too—if you evaluate it honestly, that is. Rand’s thinking is a pleasant enough fiction for those at the top of the heap, but it’s wholly improbable, naïve—and rude.

Pry a little further, however, and Rand’s thinking quickly becomes quite cruel. In a 1967 article entitled “Requiem for Man,” Rand issues a scathing rebuttal to Pope Paul VI who dared suggest that capitalists must be mindful of global wealth disparity and the sufferings of the poor, and recognize a social obligation to help the unfortunate (the Vatican has notably issued similar remarks in a recent statement on the global financial crisis). Rand slams the Pope for urging us to show brotherly love to poor 3rd world “savages." To the contrary, she declares, when civilized man “discovers entire populations rotting alive in such conditions” he should not feel pity, but “a burning stab of pride” for “the achievements of his nations and his culture…” Amazingly, Rand fails to acknowledge how much the civilized nations have prospered at the expense of the global poor thanks to imperialism. Would she have us applaud the imperialists for their opportunism and exploitation?

In Rand’s view, the poor are better subject to our derision than compassion. What they want, what the Pope calls us to be sensitive to, are perfectly despicable needs: “The inhabitants of the world [that the Pope’s encyclical] proposes to establish are robots tuned to respond to a single stimulus: need—the lowest, grossest, physical, physicalistic need of any other robots anywhere: the minimum necessities, the barely sufficient to keep all robots in working order, eating, sleeping, eliminating, and procreating, to produce more robots to work, eat, sleep, eliminate, and procreate.” Her message to the millions starving in the world: your needs are not worth our consideration; just die why don’t you.

I’ve long wondered why—or how—Rand’s disciples conveniently, miraculously, ignored her heinous conclusions. It’s time Rand was seen for what she is—no glossing over it. Clearly, it’s not acceptable for our political leaders to be associated with her thought. Conservatives—any of her disciples indeed—have a clear choice: marginalize her work accordingly, or explain how a vision of radical individualism such as Rand’s does not lead to hate. A lot could be gained by the latter. At the very least, it might reveal the appropriate boundaries of our individualism, and make us more thoughtful to the vulnerable among us.

Firmin DeBrabander is Chair of Humanistic Studies and Associate Professor of Philosophy at the Maryland Institute College of Art.
Conservatives or Republitarians are like children who fall in love with superheroes like the simplistic ones Rand portrays in her fictional novels. In the real world we grow up and realize we're not cartoon characters and never can be. The rabid Right never grows up. They hold on to childish notions or delusions they got theirs without any help or any luck or any of the infrastructure a civilized society provides via taxes.

Why Should Supreme Court Justice Elena Kagan recuse herself from ruling on the Affordable Care Act

Why Should Supreme Court Justice Elena Kagan recuse herself from ruling on the Affordable Care Act

The proto-fascist National Review Online's Increasingly Dishonest Push For Kagan To Recuse Herself From Health Care Case

National Review Online's Carrie Severino is still pursuing her quixotic quest to have Supreme Court Justice Elena Kagan recused from any cases dealing with the Affordable Care Act. In a recent blog post and report, Severino has concluded that based on the evidence she has seen, Kagan should "recuse herself from any consideration of [the Affordable Care Act's] legality before the Supreme Court."

The charge is baseless. Kagan has said that she had not been involved in any substantive discussions of the health care reform law, the constitutionality of the law, or litigation involving the law.

And importantly, faced with the same evidence that she's now citing, Severino acknowledged back on April 11 that she didn't  "see enough evidence to know whether Justice Kagan must recuse herself from considering the upcoming Obamacare challenges."

The facts haven't changed, but Severino's conclusions certainly have. It seems that Severino hoped she would find a smoking gun that required Kagan's recusal. And when she failed in that attempt, Severino simply reversed herself on what those facts mean.

Severino's Judicial Crisis Network put out a report arguing that Kagan took part in strategizing about health care reform litigation when she was solicitor general in the Obama administration and therefore must recuse herself from considering the case as a judge.

Severino's report cites a January 2010 email from Kagan's then-deputy in the solicitor general's office, Neal Katyal, responding to an Obama administration request that the solicitor general's office send a representative to a meeting to discuss how to defend the health care bill from legal challenges. In the email Katyal said, "Let's crush them. I'll speak to Elena and designate someone [to attend]." Katyal then became the solicitor general's office's point person on health care litigation.

But Severino already knew about this exchange on April 11 when she said there was no evidence requiring Kagan to recuse herself. Indeed, Severino cited that e-mail in an April 1 blog post about the recusal issue.

Severino next cites an email in which Katyal said he would "bring in Elena as needed." Severino noted this exchange in her April 1 blog post as well.

Severino then cites an email in which Katyal said he wanted to make sure the office was "heavily involved even in the dct [District Court]." Severino noted this exchange in her April 1 blog post as well.

Severino also argues that, because some material has been redacted from FOIA disclosures due to an exemption for certain privileged materials, Kagan needs to recuse herself. As an example, Severino cites an email in which Katyal says, "In light of this, for what it is worth, my advice (I haven't discussed this with Elena, but am cc'ing her here) would be that we start assembling a response, [material redacted] so that we have it ready to go." This email (including the redaction) was the third in a set of documents to which Severino linked in her April 1 blog post. As a whole, the redactions were almost impossible to miss in that set of documents.

So almost every piece of evidence Severino cites in her report consists of something she already mentioned on April 1. And all of the evidence was available by then. And yet on April 11, she concluded that there was nothing she had yet seen that required Kagan's recusal.

Furthermore, Severino is not the only conservative who has come to the conclusion that these documents did not require Kagan's recusal. Based on the same set of documents, Terry Jeffrey of the conservative CNS News wrote on March 29:

Did Kagan at any time as solicitor general express an "opinion concerning the merits" of the lawsuits filed against the health care law -- an act that would trigger one of the recusal standards in 28 U.S.C. 455? In the text of the emails the Justice Department provided to CNSNews.com, Kagan does not do so.

So what has changed since Severino said that she didn't see anything that required Kagan's recusal? Well, for one thing, conservative judicial icons Jeffrey Sutton and Laurence Silberman have written decisions upholding the constitutionality of the individual mandate.

Maybe the anti-health care reform forces are just getting desperate.

As is usually the case with conservatives their arguments are not based on honor or principles but what they want. They want things the way a child is obsessed with wanting something. There is no rhyme or reason, they're just going to whine and cry until they get what they want. That is actually most of what the radical right-wing National Review stands for - they demand things and they're going to throw a temper tantrum until they get it.

Koch Brother Front Group Americans For Prosperity Pushes Smear Campaign Against Me By Lee Fang

Levi Russell, Americans for Prosperity Director of Public Affairs, contributed to a blog post calling Lee a "liar." Russell, however, erroneously quoted the conversation and has refused to issue a correction.

Levi Russell, Americans for Prosperity Director of Public Affairs, contributed to a blog post calling me a “liar.” Russell, however, erroneously quoted the conversation and has refused to issue a correction.

Yesterday, Americans for Prosperity, the corporate front group founded and financed by the Koch Brothers, posted a blog post titled: “Lee Fang Lies.” The post, which was Tweeted and promoted by other conservative groups, accuses me of misrepresenting myself at the Americans for Prosperity Defending the Dream Summit last Friday. The allegations are all demonstrably false. I called AFP on the phone today to explain that their post was false and gave them an opportunity to retract it. The Americans for Prosperity’s Levi Russell, the press person involved in the smear, responded: “No, I’m not going to correct it.”

The Americans for Prosperity blog post claims that, in order to receive a press credential, I said that I was a student from California (view a copy of the post here):

Lee Fang, a blogger with “Think Progress,” lied to event organizers about his residency and status in an attempt to gain media access to the Defending the American Dream Summit, held this past weekend at the Washington Convention Center. Fang told Americans for Prosperity Foundation that he is a student “visiting from California,” who “had to fly home tomorrow” and had really hoped to cover the event.

However, Fang is listed as a “resident of Prince George’s County, Maryland” on his ThinkProgress author page. His wikipedia page says that he “attended college at the University of Maryland, College Park.” [...] Fang regularly impugns conservative authors as dishonest, yet characteristic of his reporting, his preferred tactic is dishonesty and lies.

I did say that I live in California, and that I was hoping to attend the conference before going home the next day. That is because I live in California and was traveling home that Saturday. Despite Americans for Prosperity’s best research efforts, I moved away from my native Prince George’s County several years ago, and relocated finally to northern California about seven months ago. The biography page cited by Americans for Prosperity is obviously out of date. Moreover, Americans for Prosperity never reached out for a clarification and, if they had looked past Wikipedia, I broadcast the fact that I now live in California on a regular basis when I appear on television and radio.

Unfortunately for Americans for Prosperity, I had been interviewing folks going into to the event on my way into the conference, and had a voice recorder still on in my pocket during the exchange with the group’s media staffers. The transcript of the entire conversation between myself, my ThinkProgress colleague Travis Waldron, and the Americans for Prosperity media staff is on tape, and clearly shows that I introduced myself as a ThinkProgress reporter, not a “student.” Click more at the bottom of the screen to read a transcript of the tape, or listen below here:

Contacted today, Americans for Prosperity public affairs director Levi Russell said he was responsible for the post because he “wanted to call you out.” Russell would not tell me the last name of the other Americans for Prosperity staffer I spoke to, who identified himself as Adam. Asked to issue a correction and apology for the smear, Russell said: “No, I’m not going to correct it.”

The fake patriots who call themselves conservatives smear for the same reasons they whine and throw temper tantrums. bringing truth and honor into the discussion just makes their pointed heads spin.

Banana Republic Democracy In Wisconsin Guns Welcome Cameras Excluded

Banana Republic Democracy In Wisconsin Guns Welcome Cameras Excluded

Eighteen people were arrested Tuesday for using cameras in the Wisconsin Assembly gallery, including the editor of The Progressive magazine, Matt Rothschild.

Rothschild and others had gone to the capitol to protest a series of arrests in recent weeks of individuals who carried signs or took photos or video in defiance of an Assembly ban.

"We ought to have a right to take a picture," Rothschild said.
Guns, Yes. Cameras, No.

The protest was organized through a Facebook event called "Concealed Camera Day at the Capitol!" The event coincided with the implementation of Wisconsin's new concealed carry law, which allows residents to carry a concealed firearm -- including inside the Assembly gallery.

Stephen Colbert said Governor Walker was bringing "a new freedom to America's dairyland" with the concealed carry law, but said people would not see "images of gunfire in the statehouse" because of the camera ban. "Thank God. Cameras are dangerous," he said.

On the agenda in Tuesday's session was a bill to institute the Castle Doctrine, a "shoot first, ask questions later" bill that gives a person immunity from civil and criminal liability if they shoot another in self defense in their home, work, or vehicle. The American Legislative Exchange Council also has a model Castle Doctrine bill -- see the side-by-side here.

Event organizers were clear that the protests were not about the gun laws, but instead about protecting First Amendment rights.
But is it Legal?

The Open Meetings law includes this provision (§19.90):

"Use of equipment in open session. Whenever a governmental body holds a meeting in open session, the body shall make a reasonable effort to accommodate any person desiring to record, film or photograph the meeting. This section does not permit recording, filming or photographing such a meeting in a manner that interferes with the conduct of the meeting or the rights of the participants."

The statute also contains this provision (§ 19.87(2)):

"No provision of this subchapter which conflicts with a rule of the senate or assembly or joint rule of the legislature shall apply to a meeting conducted in compliance with such rule."

The legal issue here appears similar to the one that arose in the challenge to Governor Walker's collective bargaining law. In that case, Dane County District Attorney Ismael Ozanne alleged that the union-busting law should be struck down because it was passed in violation of another provision of the Open Meetings law requiring notice. In part, Ozanne's challenge failed because the legislature had passed a rule that trumped the Open Meetings law.

Likewise, here the Assembly had a rule banning cameras and video, but under the court's ruling in the Ozanne suit, that rule trumped the Open Meetings law permitting their use.

Despite this, both the Wisconsin and U.S. Constitutions have provisions protecting the right to free speech, free assembly, and a free press. "The gallery is a free speech area," says attorney Jim Mueller, who was ticketed in October for violating the Assembly rule. "Even if there are rules against signs, they're unconstitutional. It is our right to peaceably assemble and petition the government."

If we said how funny it was that Governor Walker and other Rethugicans allowed guns but no sunshine from the free press, we would be mistaken in thinking this is some kind of weird aberration of the the Soviet Union's old Politburo here in the U.S. There is nothing strange here. Republicans know that the greatest threat to their anti-American, anti-Democracy agenda is letting the public know what they're doing. Sunshine, like that brought by cameras and recorders is the kind of disinfectant that conservatives know will shine a light on their shady corrupt style of gov'mint.

A History of Sexual Harassment is The Least of The Corrupt Wing-Nut Herman Cain's Problems

A History of Sexual Harassment is The Least of The Corrupt Wing-Nut Herman Cain's Problems

Mark Block, whose face is now familiar to thousands as the Smoking Man in the Cain campaign's latest video, told reporters that Cain was unaware of any settlements paid to the two women who made the accusations while Cain served as president and CEO of the National Restaurant Association, as Politico reported. But the reasons for Block's discomfort likely went beyond Cain's situation to his own. Just hours before Politico burst forth with its explosive accusations, the Milwaukee Journal Sentinel laid out a case that suggests significant illegal campaign activity on Cain's behalf by a nonprofit organization, Prosperity USA (also known as America's Prosperity Network), controlled by Block and linked to David Koch's Americans for Prosperity. As AlterNet has reported, Block, the former director of AFP's Wisconsin chapter, has long been known for playing dirty in politics.

Pay to Play?

Prosperity USA, described as a 501(c)(3) in its incorporation documents (and which now seems to be defunct), appears to have been footing the bill for Cain campaign expenses, including a highly unusual payment of $100,000 to the right-wing Congress of Racial Equality in advance of a major speech by Cain. Daniel Bice, who writes the Journal Sentinel's No Quarter blog, reports that the payment to CRE appears to have been disbursed from $150,000 in loans raised from unnamed donors. While Bice asserts that Cain was apparently not paid for that appearance, the New Yorker's Jane Mayer this month uncovered information suggesting that Cain's speaking fees are not directly reported as such on his disclosure forms to the Federal Elections Commission, but are shielded from public view as transactions that take place between his private company and the speaker's bureau representing him. Writes Mayer:

Yet, mysteriously, Cain discloses no payments from the Washington Speakers Bureau on his federal forms. Instead, on his 2011 F.E.C. form, he lists unspecified payments of between $50,000-$100,000 to his company, the New Voice, which he describes as a “public speaking” and “publishing” entity.

A Visit With Mr. Koch

Among Bice's revelations is a record showing that Prosperity USA paid for Block's travel to meet with David Koch, the billionaire right-wing funder behind Americans for Prosperity and its foundation, and AFP president Tim Phillips in Washington, D.C., in January -- after Block was named "chief of staff" of the Cain campaign. Although the records Bice combed through do not specify a date for that trip, we know that both Phillips and Koch were in the nation's capital to celebrate the swearing in of the new congress on January 6, and to see the speaker's gavel passed from Rep. Nancy Pelosi, D-Calif., to John Boehner, R-Ohio.

Koch and Phillips had much to celebrate that day, not only in the transfer of power from the Democrats to the Republicans in the House of Representatives, but also for the high number of Tea Party-allied freshmen lawmakers in the new class who owed their good political fortunes to Koch and Americans for Prosperity. They were particularly successful in Wisconsin, where they helped to elect two new congressmen, Sean Duffy and Reid Ribble, and managed to unseat long-time U.S. Sen. Russell Feingold with their ally, Ron Johnson.

Until he signed on as Herman Cain's campaign manager in December, Block ran the Wisconsin state chapter of Americans for Prosperity. In addition to helping to send a handful of Koch-backed lawmakers to Washington, Block also helped elect Scott Walker to the governor's mansion along with a cadre of right-wingers to the state legislature, where they wasted no time in launching an assault against Wisconsin's public employees and their unions. And it was Block who recruited Herman Cain to run for president.

Taxpayer Subsidy for Cain's Private Jet?

Nonprofit organizations classified as 501(c)(3) under the IRS code are forbidden to engage in electioneering. Yet Prosperity USA lists on a rather messy statement of profit and loss, uncovered by Bice, that it is owed more than $40,000 from Friends of Herman Cain (the official name of the fundraising arm of Cain's presidential campaign), including at least $16,000 for Cain's travel on the charter jets of Hill Aircraft to appear at events sponsored by Americans for Prosperity, as well at an event in Chicago called RightNation, which the statement says Cain attended at the "request of AFP." Hill Aircraft, on its Web site, offers this description of its services:

Our world class FBO facilities offer all the amenities for both passengers and pilots, including computer work stations with internet access, plasma TV screens for catching up on national and world events, pilots lounge with theatre seating and security camera monitors and state of the art flight planning facilities. Our line technicians are NATA Safety 1st trained and Hill Aircraft is a State of Georgia recognized drug free workplace. Our concierge services can take care of passenger and crew ground transportation, hotel reservations and catering, we can even arrange for sporting event tickets or a round of golf. Let Hill Aircraft show you why we have been named the #1 FBO in Georgia multiple times.

Payment for this campaign travel by a tax-exempt organization, which Prosperity USA claims to be, would amount to a taxpayer subsidy of plush accommodations for a political candidate. It appears, according to the Journal Sentinel, that Prosperity USA also forked over $3,700 for iPads used by the Cain campaign.

Koch-Linked Nonprofit Pays Singer of Cain Anthem

The records unearthed by the Journal Sentinel also note a payment of $1,500 to Krista Branch, who sings the Cain anthem, "I Am America" in the campaign's videos. Bice also reports that Branch's husband, who composed the song, works for the Cain campaign:

Branch's husband, Michael, who wrote the song, has been paid $11,250 in his role as the Cain campaign's Tennessee director and $7,360 as a fundraising consultant.

Prosperity USA also appears to have provided the funding for Prosperity 101, the Koch-linked workplace indoctrination program on which AlterNet (in partnership with the Investigative Fund at the Nation Institute) published an exposé last June. Our reporting showed Prosperity 101, which was fronted by Cain and Wall Street Journal editorial board member Stephen Moore, to be a for-profit venture, with Linda Hansen, the Cain campaign's current fundraiser, listed as its registered agent. Prosperity USA's profit and loss statement shows $12,000 billed to the nonprofit by Hansen's apparently for-profit workplace program, with a note saying that another $30,000 worth of bills from Prosperity 101 had just been submitted by Hansen for payment.

Perhaps Cain should be running for president of some backwards banana republic. One that buys and sells power and votes like the infamous Koch brothers. Conservatives have long run an extensive shadow network of dirty money. Its what they do. Conservatism by definition is the corruption of democracy. That is why they wrap in in the flag in the bible. They have actually got some poor rubes believing they love their country and want the best for America.
